PROPERTY

We act for landlords, asset managers and tenants in commercial property related disputes including boundary disputes, rights of way, easements, adverse possession claims, Lis Pendens applications and vacations, co-ownership disputes and disputes involving bank charges and securities.

LANDLORD & TENANT

We advise and represent clients in contentious commercial landlord & tenant matters, including disputes over lease terms, termination and securing vacant possession.

CONSTRUCTION

We advise developers, contractors and clients in standard form construction contracts (RIAI, PWC, NEC, JCT, FIDIC) and advocate in construction adjudication, conciliation, mediation, arbitration and litigation.

PLANNING & ENVIRONMENTAL

We represent clients in planning judicial review proceedings, rezoning judicial review challenges and in judicial reviews of environmental decisions. We act in Environmental Protection Agency (EPA) and other regulatory prosecutions. We represent parties in climate-related litigation.

CYBER

We advise companies and cyber Insurers on GDPR compliance and data protection regulations. We provide emergency incident responses for data breaches and cyber-attacks and guide clients through containment, mitigation and investigation of cyber incidents and advise on legal and regulatory notifications.

TECH

We represent clients in technology related disputes, including: injunctive relief; contract termination disputes; SaaS conflicts; software implementation issues, licence breaches and IP enforcement due to many global online/digital content providers in Ireland. Court applications include injunctions, Norwich Pharmacal relief orders and Mutual Legal Assistance (MLA) applications.

DATA

We represent clients in Data Protection Commission investigations and liaise with regulatory authorities. We are instructed in data protection litigation and in claims arising from data breaches and cyber incidents.

CRISIS MANAGEMENT

We are there in the initial crucial 48 hour period, providing immediate advice, designing and executing legal strategies, assembling multidisciplinary teams to implement strategy and managing critical time-sensitive announcements and notifications to regulatory bodies.

CORPORATE & PARTNERSHIP

We are instructed to represent parties in boardroom disputes, partnership disagreements, breach of warranty claims, minority oppression claims, actions against directors for breach of fiduciary duties and injunction applications to protect shareholder/partner interests.

INSOLVENCY

We act for directors, companies, insolvency practitioners and institutions in challenges to the validity of examiner, receiver and liquidator appointments. We apply for and defend director restriction and disqualification applications. We act for parties in compulsory liquidations including High Court wind up petitions.

FRAUD &
ASSET TRACING

We act in civil fraud claims involving freezing, search and disclosure orders, injunctions to preserve assets and applications to reverse fraudulent transfers to restrain the dissipation of assets. We identify and trace hidden assets, including property, investments and corporate structures using investigative techniques, including forensic technology and local intelligence.

WHITE COLLAR
CRIME

We assist clients in internal and external regulatory investigations, including law enforcement investigations relating to corporate fraud, market abuse, insider trading, health and safety violations, bribery, corruption and other financial crimes. We advise on dawn raids, mandatory reporting and governance and regulatory compliance advice.

Investment Funds

We assist ManCo’s, boards, service providers and shareholders in disputes relating to concentration limits, ineligible assets, NAV calculations, charging of fees and expenses, redemption, termination and investor led claims. We advocate in disputes between fund boards, shareholders and service providers. We navigate regulatory obligations under UCITS Regulations and Central Bank of Ireland AIF Rulebook.

Banking

We advise clients in mis-selling claims, misrepresentation claims, contractual disputes, interest overcharging claims, enforcement of security disputes and exercises of default. We represent parties in financial instruments, swaps and structured products litigation.

CRYPTO

We act for exchanges, custodians, and purchasers/sellers where disputes or regulatory matters arise including sale, breach of contract, civil fraud, investments and mis-selling. In cases of crypto fraud and asset recovery we obtain freezing orders and injunctions to prevent the movement of cryptocurrencies.

INSURANCE

We advise clients on policy wording and exclusion clauses. We represent policyholders and insurers in coverage disputes. We pursue subrogated recovery for insurers. We act for plaintiffs, professionals and insurers in professional negligence claims in respect of construction, property, finance, insurance and legal industries and associated regulatory.

SPORT

We represent sports governing bodies, clubs and athletes in contract, rules and policy drafting. We advise on regulatory matters including disciplinary and appeals hearings, on/off-field and doping infractions, selection disputes and jurisdictional challenges. We provide representation in domestic and international arbitration and the High Court.

EMPLOYMENT

We advise employers and senior employees in contentious exits and terminations, including representation before the WRC and injunctive relief before the High Court. We conduct independent investigations of workplace incidents and behaviour.

REPUTATION

We defend and prosecute claims in defamation, privacy and intellectual property infringement, including injunctive relief to prevent publication of defamatory statements or unlawful disclosures. In respect of social media platforms we advise on notice and takedown procedures.

TAX

We provide representation in proceedings before the Tax Appeals Commission (TAC) and challenges before the Irish High Court, Court of Appeal and Supreme Court. We provide strategic options for contesting, litigating and settling tax disputes.

ENFORCEMENT of JUDGMENTS

We assist international individuals and companies in enforcing foreign judgments and arbitral awards against Irish companies and individuals under EU law (Brussels 1 Recast Regulation), Lugano and Hague Conventions and under the New York, Washington and Geneva Conventions in respect of arbitral awards.

INTERNATIONAL ARBITRATION

We represent parties in international arbitration disputes before the major European arbitral institutions such as: International Chamber of Commerce (ICC); London Court of International Arbitration (LCIA); Court of Arbitration for Sport (CAS) and; ad hoc arbitrations under UNCITRAL and other rules.

AVIATION

We advise clients on repossession strategies and coordinate multi-jurisdiction Court orders for repossessing aircraft including detention, arrest and seizure. We make International Registry applications before the Irish High Court under the Cape Town Convention and conduct litigation under the Montreal Convention.

REGULATION & INVESTIGATIONS

We advise in drafting and interpreting rules and regulations. We conduct regulatory investigations and enquiries, including responses to regulator reviews and regulator on-site inspections. We represent organisations at hearings and sanctions processes. We conduct independent investigations on behalf of third parties.
